RIVERVIEW PLANNING COMMISSION MEETING

MINUTES
Meeting called to order by Chair Bob MacIntosh at 6:00 pm.
PLEDGE OF ALLEGIANCE
ROLL CALL-Elsie Jensen, Paal Hansen, Erv Limberg, Bob MacIntosh,
Harley Trosch, and Tawny Booth were all present. Also present
were Jean Lester, Robert Lester, Jim & Patti Wisneski, and
Shawn Fidler.
CERTIFICATION OF OPEN MEETING LAW-Minutes and Agendas were
posted in all three places and on the web site.
APPROVAL OF MINUTES- Erv Limberg moved to approve as printed
and Elsie Jensen seconded. Motion carried.
OLD BUSINESS-Construction Deposit Agreement is tabled until
the June 29th Planning Commission meeting. More information needs
to be obtained.
Update on County Billboard Ordinance - The Oconto Falls/Gillett
area were interested in having the county change the existing
ordinance into a simplified version, understandable and uniform
for all. All towns, cities, & villages were invited, along
with Pat Virtues. The end result there is 3 distinct areas in
the county (tourism, farming, and the bay area) with different
needs. The existing ordinance reflects the different needs and
will remain the same.
NEW BUSINESS- The results of an ATV Road Access survey that
was conducted on Paya Lake and N Paya Lake Road. Jim Wisneski
Hidden Bear Trail ATV Club secretary presented the survey results,
the number sent was 82, total surveys returned were 61 or 74%,
with 27 or 44% Agree, and 34 or 56% Disagree, therefore, access
for ATV travel on these roads are not granted. Jean Lester was
upset she lives about ¼ mile from the ATV trail and her
son Rob works at Mulligan's Sport Bar and is disabled and cannot
ride his ATV to work but the snowmobiles have access to ride
wherever they want. Bob MacIntosh apologized for her frustration
however the Planning Commission has to follow the process that
was set up with the ATV clubs. Elsie Jensen stated that she saw
an ATV with a Disability sticker on the back and that Jean could
call the Zoning office. Bob MacIntosh asked Tawny Booth, secretary
to call the Zoning office and find the needed information on
how to obtain a disability permit and get back to Jean with that
information.
The use of a petition to use to open small roads to request access
- Jim Wisneski presented a Town Road Access Request form to use
for all small town roads to get access to ride ATV's and wanted
to see what the Planning Commission thought of the form. He also
presented a petition for ATV access on Nolting Lane which is
a dead end road off of Tar Dam road, Brett Freiberg one of the
property owners obtained 6 out of 7 signatures for who agree
to allow access. Bob MacIntosh stated that the request was fine
and that if they needed to verify signatures that the planning
commission could do that, however, the format is to get the survey
results, and have the survey put on the agenda a month ahead
of time giving enough time so that any property owners or any
interested party can come to the meeting and voice their opinions.
Doing the survey vs. the petition makes sure that every property
owner on the town road gets the survey. The ATV clubs need to
obtain the mailing labels from the county for all property owners
on the town road they want to do the survey. The petition that
was presented for small town roads was fine, however, has to
be posted a month ahead of time on the agenda so it gives the
planning commission time to look at tax bills and parcels to
see how many property owners are on the small town roads. The
planning commission does not know how many property owners are
on all town roads. The petition for access of ATV's on Nolting
lane will be put on the agenda for the June 29th planning commission
meeting.
Discuss road rite of way for ATV's -Harley Trosch stated that
in the last issue of the Wisconsin Town Association it was written
by the town association lawyer regarding roadways that the town
is responsible for the shoulders of the roads if there is any
accidents from ATV's that the town is liable, this is being brought
to the Commissioners has to what precautions the town can do
or any actions the ATV clubs can do to help prevent this. Jim
Wisneski stated that they have speed limit signs up and stay
on pavement signs. Jim stated that if there are any issues with
town roads that the ATV clubs will let the town no and vice versa.
Discuss fees for map reviews - other planning commissioners are
charging for this service. The commissioners need to discuss
and determine a charge. The planning commissioners decided that
they would not charge for this as this is a service that they
are here to provide.
ANY AND ALL OTHER BUSINESS
The planning commission would like to set up an onsite visit
with Wisconsin Public Service to look at our current capacity,
what the site may potentially need, and what would their recommendation
be for alternate feeder choice as we continue to do projects.
We would like to try and get someone here for our next meeting.
